Detailed description of goods and/or services
Radical Mobility (Pty) Ltd, is a business in the medical devices industry manufacturing and distributing devices and their components such as power wheelchairs, standing power wheelchairs, commodes, pressure care cushions, walkers and bathing aids.
CONDITIONS OF SALE
Terms of Payment
On order a 50%, deposit is required to secure the order for production. The full purchase price of goods sold shall be payable on delivery if delivered by Radical Mobility (PTY) Ltd or before delivery if delivered by door-to-door courier or collected by the client. In the event of the Purchaser canceling an order less than seven (7) business days after being placed, they will be liable to pay damages equal to an amount not exceeding 33.33% (a 3rd) of the total Invoice value. If the order is cancelled after fifteen (15) business days the deposit becomes non-refundable due to material and customisation.
The manufacturer shall, by way of repair or at its option, by replacement, make good any defects or alterations in the goods sold (as explained in point 1), which may appear because of faulty materials, workmanship or design provided that the goods shall have been used under normal operating conditions for the purchase for which they were intended and provided further that the goods are returned to the seller. All other warranties will be upheld by the manufacturer as stipulated in the product manual.
Save as otherwise herein provided the seller shall be under no liability to the purchaser or any other person whether in contract or delict, in respect of:-
3.1 defects in the goods.
3.2 injury loss or damage whatsoever arising from such defects;
3.3 injury loss or damage, howsoever arising from the use, misuse or abuse of the goods by the purchaser or any other person/s;
3.4 the repossession of the goods by the seller or late delivery;
Dispatch of goods.
Goods will be dispatched by road, rail, sea, air or personal delivery at the cost of the purchaser. The Purchaser agrees and understands that delivery dates are given in good faith and that late deliveries however caused, shall not give rise to any claim for damages or consequential loss from any cause whatsoever.
Reservation of ownership
Despite delivery of any goods to the purchaser, ownership therein shall not pass to the purchaser until payment in full of all amounts owing by the purchaser to the seller or any other 3rd party, shall have been made.
The purchaser shall pay interest on overdue accounts at the rate of 2% above the prime overdraft rate charged by First National Bank from time to time or at the maximum permission rate in terms of the Usuary Act. No warranty or Support, deliveries or additional service of any nature will be provided whilst any default exists in respect of terms of payment or whilst any dispute exists in respect of outstanding payments including disputes related to interest accrued due to late payments.
Legal proceedings and domicilium
Should the seller instruct its attorneys to institute action against the purchaser, the purchaser shall pay the cost of such action on the scale as between attorney and client so that the seller shall receive a full indemnity in respect of such costs.
The purchaser consents to the jurisdiction of the Magistrate’s Court for any proceedings to be instituted hereunder and chooses domicilium citandi et executandi for all purposes arising here from the address reflected on the invoice.
Variations and Amendments
No variation or amendments to these conditions shall be of any force or effect unless reduced to writing and signed by the Seller and the Purchaser.
Copy of Conditions of Sale
The purchaser acknowledges that his attention has been drawn to these conditions and that a copy hereof has been tendered to him with the order forms and in the product manual.
